This HUD notice announces the Fiscal Year 2027 Fair Market Rents (FMRs) used to set payment standards under the Housing Choice Voucher program and other HUD programs, effective October 1, 2026. It explains the methodology changes for FY 2027, including a new utility inflation factor calculation, and describes procedures for PHAs and the public to submit comments or request reevaluation of specific area FMRs by the comment deadline. Public Housing Agency Compliance Deadline for Sections 102 and 104 of the Housing Opportunity Through Modernization Act (HOTMA) and Alternative HUD-50058 Reporting Instructions

This notice sets January 1, 2027 as the deadline for most public housing agencies to fully comply with sections 102 and 104 of HOTMA, except MTW PHAs and PHAs exclusively using FRS software, who will receive future guidance. PHAs can comply either by using the updated 2024 Form HUD-50058 or, if unable to convert in time, by using the 2020 Form HUD-50058 with alternative reporting instructions detailed in Appendix B. It partially supersedes Notice PIH 2024-38 but does not change the earlier July 1, 2025 deadline for select HOTMA provisions.

Revised Guidance for Reasonable Accommodation Exception Payment Standards for the Housing Choice Voucher Program

This HUD notice updates guidance for PHAs on handling reasonable accommodation requests for exception payment standards (RA EPS) in the Housing Choice Voucher program, superseding PIH Notice 2013-18. It removes the prior requirement that a family receiving an RA EPS pay 40 percent of adjusted income toward gross rent at initial approval, and clarifies review, calculation, submission, and denial processes, including when HUD approval is required and when subsequent requests for a higher RA EPS should be submitted. This matters because it affects how PHAs evaluate disability-related housing needs and ensure equal access to the HCV program.

Extension of HOTMA Compliance Date for Tribes, TDHEs, and DHHL

This notice extends the HOTMA compliance deadline for Indian Tribes, Tribally Designated Housing Entities (TDHEs), and the Department of Hawaiian Home Lands (DHHL) to January 1, 2026. Tribes and TDHEs that use the 24 CFR part 5 definition of annual income for IHBG, and DHHL for NHHBG, are not required to adopt the new HOTMA income definition until that date, though they may choose to do so earlier. This gives them more time to update processes, procedures, and policies while continuing to rely on the pre-HOTMA definition of annual income in the meantime.
