Section 3 Benchmarks for Creating Economic Opportunities for Low- and Very Low-Income Persons and Eligible Businesses

HUD is updating its Section 3 benchmark Notice as required every three years, but after reviewing available labor hour data, has determined the data is not sufficiently representative to change the current benchmark goals. The existing benchmarks from the original Section 3 Notice will remain in effect, and HUD is requesting public comments on experiences and challenges in meeting these goals. This matters to PHA staff because it confirms that current Section 3 compliance benchmarks for workers remain unchanged, though reporting requirements and data collection continue.

Privacy Act of 1974; System of Records

HUD's Office of Public and Indian Housing is modifying the Privacy Act system of records notice for IMS/PIC and HIP, which are national repositories tracking PHA, TDHE, and HUD-assisted family data. The update adds three new routine uses (numbers 19, 20, and 21) and incorporates two previously added ones (17 and 18), updates the system manager and contact information, and clarifies categories of records, record sources, and electronic collection methods. PHA staff should be aware that this affects how tenant and program data in IMS/PIC and HIP may be shared and used, and comments on the changes are being accepted through October 30, 2026.

National Standards for the Physical Inspection of Real Estate: Scoring Notice

This HUD notice requests public comment on three revisions to the NSPIRE Scoring Notice: a revised compliance date for new affirmative requirements, a correction to the unit sample size table, and corrections to calculation examples. Beginning October 1, 2026, deficiencies under the new affirmative requirements (such as fire-labeled doors, GFCI outlets, guardrails, HVAC, and lighting) will count in a property's inspection score for Public Housing and Multifamily Housing. PHA staff should submit comments by November 30, 2026, and review the corrected Table 9 sample sizes and example calculations.

Revision of Operations Notice for the Expansion of the Moving to Work Demonstration Program

This notice revises HUD's Operations Notice for the Expansion of the Moving to Work (MTW) Demonstration Program, which was last published August 28, 2020 with technical revisions in March 2025. The revisions cover funding flexibility, program administration, special purpose vouchers, and multiple MTW waivers in Appendix I and II, including changes to stepped rent, imputed income, work requirements, and local non-traditional activity limits. HUD is soliciting public comments on these revisions, with a 60-day comment period followed by an additional 30-day period.

Demolition and/or Disposition of Public Housing Property, Eligibility for Tenant Protection Vouchers, and Associated Requirements

This notice explains the requirements PHAs must follow to apply through HUD's Special Application Center (SAC) to demolish and/or dispose of public housing property under Section 18 of the 1937 Housing Act, including justification criteria, resident and government consultation, environmental review, and relocation rules. It also clarifies how these actions interact with Tenant Protection Vouchers and RAD/Section 18 blends, and updates several definitions and thresholds from the prior notice, PIH 2024-40, which it amends.

60-Day Notice of Proposed Information Collection: Public Housing Capital Fund Program

HUD is requesting OMB approval to extend the existing Public Housing Capital Fund Program information collection, which covers a large set of forms PHAs use to receive, disburse, and account for Capital Fund modernization, development, and financing dollars. Approximately 2,771 PHAs are respondents, and HUD estimates the total annual burden at 274,599 hours and $10,270,233. This is a 60-day public comment notice under the Paperwork Reduction Act; PHA staff can review the form list and burden estimates and submit comments by the deadline.

30-Day Notice of Proposed Information Collection: Public Housing Reform; Change in Admission and Occupancy Requirements

HUD is requesting OMB approval to revise an existing information collection requiring public housing agencies (PHAs) to maintain and make available written admission and occupancy policies, including eligibility, preferences, and rent determination rules. This revision updates burden estimates to reflect the current number of active PHAs (2,667, down from 2,774). The public has 30 days to comment on the proposed collection before it is finalized by OMB.

Offset of Excess Reserves for Initial Moving to Work Public Housing Agencies and PHA Appeals

This notice explains how HUD will offset excess public housing and HCV reserves for Initial Moving to Work (MTW) PHAs—those under the MTW Standard Agreement designated before the 2016 act—for the CY2026 funding cycle, protecting 4 months of operating expenses from offset. It also describes the appeals process, including data correction appeals and statutory obligation appeals for committed capital/development activities, and the required documentation and review process. PHA staff must understand these calculation methods and appeal deadlines to protect their agency's reserves and renewal funding allocations.

30-Day Notice of Proposed Information Collection: Requirements for Designating Housing Projects

HUD is requesting OMB approval, under the Paperwork Reduction Act, to reinstate with change the information collection covering PHA plans for designating public housing projects as elderly-only, disabled-only, or elderly-and-disabled. PHAs must submit these plans for HUD approval and document justification, tenant types, supportive services, facility design, and plans for additional resources, per 42 U.S.C. 1437e(d). The notice opens a 30-day public comment period on the burden and utility of this collection, closing September 21, 2026.

Tribal Intergovernmental Advisory Committee (TIAC) Fall 2026 Meeting

This HUD notice announces the next meeting of the Tribal Intergovernmental Advisory Committee (TIAC), to be held on Thursday, September 3, 2026, at the DoubleTree by Hilton Hotel in Arlington, VA. The meeting operates under a Tribal government statutory exemption to the Federal Advisory Committee Act, so participation is limited to TIAC members and the public may not formally participate. PHA staff working with Tribal housing programs should be aware of this meeting date and that future meeting notices will be published in the Federal Register at least 30 days in advance.

Public Housing Operating Subsidy Grant Eligibility Calculations and Processing for Calendar Year 2027

This notice provides PHAs with instructions and deadlines for calculating and submitting Operating Subsidy Grant eligibility for calendar year 2027 public housing projects. It covers required forms (HUD-52722 and HUD-52723), submission deadlines, RAD conversion funding rules, and PHA responsibilities for accurate and timely data reporting. Failure to meet deadlines or submit accurate data can result in reduced or denied subsidy funding.

HUD's Implementation of the Fair Housing Act's Disparate Impact Standard; Amendments to HUD's Title VI Regulations

HUD is proposing to remove disparate-impact liability provisions from its Title VI implementing regulations at 24 CFR part 1, aligning them with DOJ's revised Title VI regulations and Executive Order 14281. This supplemental notice also reopens the public comment period on HUD's January 2026 proposed rule that would eliminate HUD's disparate-impact regulations under the Fair Housing Act. PHA staff and other HUD funding recipients should be aware that if finalized, this rule would narrow the conduct prohibited under Title VI to intentional discrimination only, potentially reducing compliance burdens. Comments on this supplemental proposal are due by October 9, 2026.

Privacy Act of 1974; Matching Program

This notice announces HUD's reestablishment of a computer matching program with DHS/FEMA and HUD's CDBG-DR grantees to share data for disaster recovery purposes. The matching will be used to transition HUD-assisted households displaced by disasters back into HUD housing, calculate CDBG-DR grant allocations, and support duplication-of-benefits and flood insurance compliance reviews. PHA staff should note that HUD Public Housing Agency Code, HUD Program Code, and recipient/household member data may be shared with FEMA as part of this program. Public comments are due by September 8, 2026, and the program becomes effective that same date unless comments require modification.

Privacy Act of 1974; Matching Program

HUD is re-establishing a computer matching agreement with HHS to compare information on HUD rental assistance participants against the National Directory of New Hires (NDNH) to verify income and prevent improper payments. Matched results will be uploaded into the EIV system and made available to PHAs, owners/agents, contract administrators, and independent public auditors to verify tenant-reported income. Public comments on the notice are due by September 3, 2026, and the matching program is expected to run for 18 months starting September 9, 2026, with possible 12-month extension.

Cyber Incident Reporting Requirements

This notice instructs public housing agencies to notify HUD promptly whenever a cyber incident occurs, such as a data breach, intrusion, or exploited vulnerability. PHAs must email HUD's Cyber Incident Response Team and their local field office contact within 36 hours of becoming aware of the incident, providing specific required information. This is important so HUD can respond quickly to protect sensitive information and coordinate mitigation steps.

Guidance on Eligibility for the Asset Repositioning Fee

This notice explains when public housing agencies qualify for the Asset Repositioning Fee (ARF), an add-on subsidy that helps cover administrative costs of demolition and disposition activities, including tenant relocation. It clarifies which projects/buildings are eligible or ineligible for ARF, defines the ARF eligibility timeline and trigger dates, and describes how to report eligible unit months and calculate ARF amounts on Operating Subsidy forms. PHA staff must ensure accurate IMS/PIC data and follow submission and revision deadlines to properly claim ARF.

60-Day Notice of Proposed Information Collection: Public Housing Mortgage Program and Section 30

Public Housing Agency Compliance Deadline for Sections 102 and 104 of the Housing Opportunity Through Modernization Act (HOTMA) and Alternative HUD-50058 Reporting Instructions

This notice sets January 1, 2027 as the deadline for most public housing agencies to fully comply with sections 102 and 104 of HOTMA, except MTW PHAs and PHAs exclusively using FRS software, who will receive future guidance. PHAs can comply either by using the updated 2024 Form HUD-50058 or, if unable to convert in time, by using the 2020 Form HUD-50058 with alternative reporting instructions detailed in Appendix B. It partially supersedes Notice PIH 2024-38 but does not change the earlier July 1, 2025 deadline for select HOTMA provisions.

Request for Applications under the Moving to Work Demonstration Program: Overall Impact of Moving to Work Flexibility and Administrative Efficiencies (Additional Agency Selection)

This notice announces the process for HUD to select one additional public housing agency (PHA) with 1,000 or fewer combined public housing and HCV units to fill the last remaining slot in the Moving to Work (MTW) Expansion's MTW Flexibility II Cohort. It explains eligibility and completeness requirements, the application package contents (MTW Plan, Administrative Efficiencies Information, and appendices), the public process and Board Resolution requirements, and the review, lottery, and selection process. PHA staff need this to determine whether their agency is eligible, how to prepare and submit an application, and by when the application package must be submitted.

Required Use of the Enterprise Income Verification (EIV) System’s Deceased Tenants Report to Reduce Subsidy Payment and Administrative Errors

This notice requires PHAs to monitor the EIV Deceased Tenants Report at least monthly and take corrective action when household members are reported as deceased, including confirming death, filing End of Participation forms, and handling unauthorized occupants or HAP overpayments. It applies to Public Housing, HCV, PBV, and Mod Rehab programs and updates prior guidance to reduce subsidy payment and administrative errors. PHAs that fail to comply may face monetary sanctions.

60-Day Notice of Proposed Information Collection: Consolidated Public Housing Certification of Completion

Implementation of Public Housing Operating Fund Shortfall Funding from Federal Fiscal Year 2026 Appropriations

This notice implements $337 million in Federal Fiscal Year 2026 appropriations to help public housing agencies experiencing or at risk of financial shortfalls, outside the normal Operating Fund Formula. It explains how HUD determines shortfall eligibility using a primary and secondary methodology based on Months of Operating Reserves and Operating Subsidy proration, and describes the application, appeal, accounting, and reporting requirements PHAs must follow. PHAs must apply for and appeal shortfall funding through the Public Housing Portal by specific deadlines, and funds must be obligated and liquidated within defined performance periods.
