Tribal Intergovernmental Advisory Committee (TIAC) Fall 2026 Meeting

HUD's Implementation of the Fair Housing Act's Disparate Impact Standard; Amendments to HUD's Title VI Regulations

HUD is proposing to remove disparate-impact liability provisions from its Title VI implementing regulations at 24 CFR part 1, aligning them with DOJ's revised Title VI regulations and Executive Order 14281. Privacy Act of 1974; Matching Program

Public Housing Agency Compliance Deadline for Sections 102 and 104 of the Housing Opportunity Through Modernization Act (HOTMA) and Alternative HUD-50058 Reporting Instructions

This notice sets January 1, 2027 as the deadline for most public housing agencies to fully comply with sections 102 and 104 of HOTMA, except MTW PHAs and PHAs exclusively using FRS software, who will receive future guidance. PHAs can comply either by using the updated 2024 Form HUD-50058 or, if unable to convert in time, by using the 2020 Form HUD-50058 with alternative reporting instructions detailed in Appendix B. It partially supersedes Notice PIH 2024-38 but does not change the earlier July 1, 2025 deadline for select HOTMA provisions.

Required Use of the Enterprise Income Verification (EIV) System’s Deceased Tenants Report to Reduce Subsidy Payment and Administrative Errors

Implementation of Public Housing Operating Fund Shortfall Funding from Federal Fiscal Year 2026 Appropriations

This notice implements $337 million in Federal Fiscal Year 2026 appropriations to help public housing agencies experiencing or at risk of financial shortfalls, outside the normal Operating Fund Formula. It explains how HUD determines shortfall eligibility using a primary and secondary methodology based on Months of Operating Reserves and Operating Subsidy proration, and describes the application, appeal, accounting, and reporting requirements PHAs must follow. Housing Opportunity Through Modernization Act (HOTMA) Sections 102 and 104 Implementation Guidance – Amendment to Attachment I Related to Interim Reexaminations

This notice revises Attachment I of Notice H 2023-10/PIH 2023-27 to change when PHAs and Multifamily Housing Owners must conduct interim reexaminations of income and household composition under HOTMA Sections 102 and 104. PHAs and MFH Owners must now conduct interim reexaminations whenever a household adds or removes members, regardless of whether income increases, decreases, or stays the same, with a limited exception during the last 3 months of a recertification period if they have a written policy against interim reexaminations for income increases. The prior version of Attachment I (Revision 2) is superseded, and the notice is being republished with the revised Attachment I as Revision 3.

Rescission of Notice H-2020-09/PIH 2020-26

This notice rescinds Notice H-2020-09/PIH 2020-26, which had provided supplemental COVID-19 guidance under the Rental Assistance Demonstration (RAD) program. It applies to PHAs that received supplemental CARES Act payments related to Covered Projects or that held resident meetings during the COVID-19 pandemic before RAD conversion.
